One year to begin with, then two years at a time. The initial non-lucrative authorisation runs for one year; a renewed one runs for two, unless by then you qualify for long-term residence instead.

The more useful thing to know is what happens when nobody answers you — because on this route the default runs in opposite directions depending on which application you have made.

The two silence rules

This is the detail that changes what you do while waiting, and it is almost never published.

On the initial application, the competent body resolves within one month of receiving the consular office's communication. If that period passes without an answer, the application is understood to have been dismissed. Silence is a refusal.

On a renewal, the application must be resolved and notified within three months of being filed. If that period passes, it is understood to have been granted. Silence is an approval.

Same route, opposite defaults. The practical consequence is that an unanswered initial application is something to act on, while an unanswered renewal is — on the face of the provision — working in your favour. Neither is a file quietly sitting open.

Renewing: the window and the grace period

Apply in the two months before your authorisation expires. Filing in that window extends the validity of your existing authorisation until the procedure is resolved, so a slow decision does not put you out of status.

And if you miss it, a filing made within three months after expiry also preserves validity while it is decided — but the regulation attaches a consequence: it is expressly without prejudice to the initiation of a sanctioning procedure for the corresponding infringement.

That is a real difference from some other routes, where a comparable grace period carries no named sanction. Treat the three months as a legal safety net with a cost, not as an extension of the deadline.

What renewal actually tests

Six conditions, and two of them surprise people.

You hold a valid authorisation, or are within the three months after it expired.

Your means still satisfy the test — sufficient for the renewal period without needing to carry out any labour or professional activity. The prohibition and the means test travel together. Savings and the Spanish non-lucrative visa covers what counts and how it is evidenced.

You have maintained health insurance throughout, and continue to hold it. Not "you have a policy now" — maintained across the authorisation you are renewing.

Dependent minors of compulsory school age are enrolled in school for the time they are in Spain, with a report from the competent regional authorities where relevant. If the documents do not establish that, the immigration office will take it up.

The fee is paid.

And you have actually lived here. The regulation requires real and effective residence in Spain for more than 183 days during the calendar year. This is a presence requirement, not a paperwork one — and it is the condition most likely to defeat someone who treated the authorisation as a right to visit.

Two further things are weighed. Where someone has been convicted and served the sentence, been pardoned, or is under conditional remission or suspension, the possibility of renewing is assessed on reports obtained by the office itself. And non-compliance with tax and Social Security obligations during the authorisation is assessed too.

There is also a lifeline. The regulation provides for the effort at integration to be taken into account, evidenced by a favourable report from your Autonomous Community recommending renewal — and says this matters principally where one of the renewal requirements is not met. If you have a gap, that report is the provision to know about.

A note on the 183 days

The 183-day condition above is an immigration requirement for renewal, and that is how we state it.

A stay of that length also has tax consequences, and they are a different subject. We are not going to characterise them here — not as reassurance and not as a warning. It is a question for a tax adviser on your own facts, and it is worth asking before you plan your year rather than after.

After the decision

Within one month of being notified that your authorisation is renewed, you must apply personally, at the competent Police station, for the foreigner identity card. Personally and within the month — it is not something that can be left.

Insurance across the authorisation

The renewal condition is about having maintained cover, which makes this a recurring question rather than a one-off purchase.

But be clear about what the law asks.
