Sick Leave in Spain: Two Processes, Not One

Being too ill to work and being formally on sick leave are different events in Spain, and the gap between them is where most of the confusion lives.

The two halves

The medical half is a doctor deciding you are unfit for work and documenting it.

The administrative half is what that document then does — within your employment, and within the social security system that may or may not pay you something.

Those are different systems with different rules, and the second one is where "it depends" starts. We state nothing about amounts or durations.

Why how you work matters so much

Employed and self-employed are in materially different positions in Spain, and the difference is not a detail — it changes who you notify, what happens to your income and what your obligations are.

If you are self-employed, this is worth understanding before you need it rather than during. The self-employment route covers the related healthcare question; the sick-pay question belongs to social security and we do not state its terms.

If you work remotely for a foreign employer, you may be in a third position again, and it is one of the places where people assume one framework and are in another.

What private insurance does and does not do

Private health insurance is healthcare. It gets you seen, treated and followed up.

It is generally not income protection. Those are different products sold for different reasons, and assuming your health policy will pay you while you cannot work is a common and expensive misreading. We describe no policy — what policies typically exclude is how to check yours.

The foreign-note problem

A note from a doctor in another country is not the Spanish process. It may be useful evidence; it is not the thing itself.
