The sequence looks impossible from the outside. Your application needs health cover. The insurer asks for identification. The Spanish identification number arrives as part of a process you have not started yet, because it depends on the application you are trying to complete.
It resolves, routinely, every day. But it resolves at the insurer's end rather than in the regulation, which is why advice about it is so inconsistent.
Why the sequence feels backwards
Because it is, in a way. A residence route that requires health cover requires it as part of the application — so the policy has to exist before the authorisation it supports. And the NIE is the number Spanish administration knows you by, which for many people arrives alongside or after that authorisation rather than before it.
So a great many applicants genuinely need to buy cover while holding nothing more Spanish than a passport. That is not an edge case. It is the normal shape of a first application, and the market knows it.
What the law says about it
Nothing. There is no provision searched for this cluster that conditions insurance on holding an NIE, and the non-lucrative requirement at article 61.2(b) of RD 1155/2024 — "Contar con un seguro de enfermedad" — says nothing about identification, residence or documentation at all. What Spanish law actually requires sets out what each route's provision does and does not contain.
That matters because it tells you where to direct the question. This is not something to ask an immigration adviser. It is something to ask an insurer.
What to ask, before you buy
"Can you issue a policy to someone who does not yet have an NIE, and what will you use instead?" That single question settles it, and the answer is the insurer's own and may differ between products as well as between companies.
"Will the documents you issue show what my application needs?" The policy is only half of it; the proof is the other half, and the two are bought together. The insurance certificate is the page for that.
"What happens when the NIE arrives?" Some processes will want the number added later. Knowing that in advance turns it into a five-minute administrative step rather than a surprise.
A distinction worth keeping

If you have been told you "need an NIE first", the useful question is: first for what? For the insurance, usually not. For other things, quite possibly.
