Bringing a Spouse or Partner on a Spanish Student Stay
Key facts
- Higher education and specialised health training only. Other study categories do not carry this right.
- At least ninety calendar days must remain on your own authorisation.
- A partner does not have to be a spouse — a registered partner or a duly proven stable partner also qualifies.
- One continuous year of living together establishes a stable partnership; with children in common, proven stable cohabitation is enough.
- Apply together and you are granted together. Joint applications are decided simultaneously.
- Your partner needs their own health insurance. The requirement applies to their application, not just yours.
Spain does allow some students to be accompanied by a partner — but not all of them, and the distinction is in the regulation rather than in consular discretion. The provision attaches to higher education, and separately to specialised health training. If your authorisation was granted for a language course, a vocational certificate or a volunteering placement, this is not a route open to you.
There is also a timing condition that catches people late in their studies: your family member's stay is granted for whatever validity remains on yours, and the regulation requires at least ninety calendar days to be left.
Which students this is open to
Higher education is the main case. The regulation ties the family provision to that category specifically.
Specialised health training is brought in by a separate article, so those students have it too.
And that is the list. Post-compulsory secondary education, pupil mobility, volunteering, the language-assistant category, Spanish and co-official language studies, preparatory courses and the vocational certificates are not covered by this provision. That does not mean a partner can never come to Spain — it means they are not coming on this basis, and a page that says "students can bring their family" without saying which students is setting up a wasted application.
The ninety-day condition
Your family member's authorisation is granted for the period remaining on yours. It is derivative: it does not run on its own clock.
And the regulation requires at least ninety calendar days to be left when the application is made. If you are in the final term of a course, check that before you do anything else — it is the condition most likely to make the answer no for someone who otherwise qualifies.
Who counts as a partner
The regulation recognises three, and the third is the one worth reading carefully.
Table 1
| Relationship | What establishes it |
|---|---|
| Spouse | The marriage |
| Registered partner | The registration |
| Stable partner | A durable link — established in any case by at least one continuous year of marital cohabitation, or, where there are children in common, by duly proven stable cohabitation |
RD 1155/2024 art. 56.2(a) (BOE-A-2024-24099), read in the BOE consolidated text 2026-10-04 — the three recognised relationships and what establishes each.
The one-year route is a floor that the regulation guarantees, not a ceiling: it says a durable link is in any case established by a year's cohabitation, which leaves room for a link proven another way.
Unmarried minor children are also within the family definition the regulation sets out, alongside the partner.
How to file
The criteria put your family member on the same footing as you for where and how the application is made — the same regime as to place and the other applicable conditions.
And they can be filed jointly. Where they are, the criteria state they are granted simultaneously. That is the sensible way to do it: it removes the risk of your partner's application attaching to an authorisation whose remaining validity has quietly dropped below ninety days while they waited.
Your partner's health insurance
This is the part most often assumed away. The insurance requirement is a condition of the family member's own application, so a policy covering only the student does not satisfy it.
The study-route standard is specific, and it is the same standard your own application was judged against: an insurer authorised to operate in Spain, benefits similar to the National Health System's basic common portfolio, and validity for the intended stay. The Ministry's criteria add that the insurer must be in the public register kept by the Dirección General de Seguros y Fondos de Pensiones, and that the cover must be free of copayments, reimbursements and waiting periods.
One qualification before you buy. If your partner will be working in Spain and registered in the corresponding Social Security regime, their cover position is different — and the student insurance rule that is deemed met by registration applies to the person working, not to the household. Establish each person's own position rather than assuming one policy or one registration covers both of you.
Health insurance for a Spanish student visa sets out the standard and where it comes from.
Cover for a student visa
Health cover is one of the requirement categories for the study route.
Health insurance is provided through our specialist health-insurance service, Spanish Health Insurance. Spanish Health Insurance specialises in private health insurance for people moving to and living in Spain.
Later, if you move to residence and work
If you complete qualifying studies and switch to residence and work, the regulation lets you apply for residence for family members who are in Spain on this student-linked stay and living with you at the time. So the stay your partner holds now can carry into the next status rather than ending with your course. From a student stay to residence and work covers who can make that move.
Frequently asked questions
Can any student bring a spouse?
No. The provision applies to higher education and, separately, to specialised health training. Other study categories do not carry it.
Do we have to be married?
No. A registered partner or a duly proven stable partner also qualifies.
How do we prove a stable partnership?
The regulation says a durable link is in any case established by at least one continuous year of marital cohabitation — or, where you have children in common, by duly proven stable cohabitation.
How long will my partner's stay last?
For the validity remaining on your own authorisation, and the regulation requires at least ninety calendar days to remain when you apply.
Should we apply together?
It is generally the better course: joint applications are granted simultaneously, which avoids the remaining-validity problem.
Does my partner need their own insurance?
Yes. The requirement attaches to their application, and a policy covering only you does not meet it.
