From a Student Stay to Residence and Work in Spain

- No visa is needed. The switch is made from inside Spain.
- Only certain study categories qualify: higher education, post-compulsory secondary education, and two of the vocational categories.
- Language studies do not qualify. Nor does volunteering, pupil mobility, or a preparatory course for specialised health training.
- You must have obtained the qualification or certificate for the studies you completed. Attendance is not enough.
- A development-cooperation or humanitarian scholarship disqualifies you, whether it came from a Spanish body or one in your home country.
- Your family members on a student-linked stay can be included in the same move.
Spain has a direct route from a study stay to residence and work, and it does not require you to leave the country or obtain a new visa. It is one of the most useful provisions in the immigration regulation for anyone who came to study and wants to stay.
It is also narrower than it is usually described. The route is open only to people whose authorisation was granted for particular categories of study. If you came to Spain on a language course, this provision is not available to you — and that is the single most important thing to establish before you plan around it.
Who the route is open to
The regulation lists the qualifying categories, and the list is closed:
Higher education. The main case, and the one most students are in.
Post-compulsory secondary education.
Two of the vocational categories — certification of technical aptitude or professional habilitation, and professional certificates at levels 2 and 3.
And specialised health training, brought in by a separate article.
If your authorisation was granted for anything else, this provision does not apply. That includes Spanish or co-official language studies, the language-assistant category, volunteering, pupil mobility programmes, and preparatory courses for specialised health training places. People in those categories are not without options — but they are not on this route, and advice that says "students can switch to work" without naming the categories is incomplete in a way that matters.
The two conditions beyond your category
You must have obtained the qualification or certificate. The regulation ties the route to having completed the studies and having the award to show for it. Being enrolled, or having attended, is not the test.
You must not have held a development-cooperation or humanitarian scholarship. This condition catches people out because it sounds remote. It covers funding from public or private bodies, under sustainable-development cooperation or humanitarian-action programmes, Spanish or from your country of origin.
How it is evidenced comes from the Ministry's own criteria rather than the regulation: a certificate from the competent authority in your country of origin, or — where you can show that obtaining one is impossible — a responsible declaration under Spain's administrative-procedure law.
Treat that honestly. The criteria state that detecting any inaccuracy, falsehood or omission of essential data is grounds for refusal while the application is being processed, or for extinction of the authorisation if it has already been granted.

Three different authorisations sit at the end of this route, and they have different requirements.

The employed route drops the requirement that would otherwise test the national employment situation — which is precisely what makes this provision valuable rather than merely available.
Your family
If family members are in Spain on a stay linked to your studies and living with you when you apply, the regulation allows you to apply for residence for them as part of the same move. That is worth planning deliberately rather than discovering afterwards.
If you studied under the old regulation
The Ministry's criteria address this directly. Holders of a long-stay study authorisation granted under the previous regulation, whose studies do not fall within the current article's categories, can still obtain this modification without a visa if they evidence the qualification or certificate obtained and meet the article's other requirements. If you studied under the old rules, do not assume the new category list shuts you out.

Frequently asked questions
Can I switch from a language course to a work permit?
Not by this route. The regulation lists the qualifying study categories and Spanish or co-official language studies are not among them.
Do I need to leave Spain or get a new visa?
No. The provision expressly works without a visa, from inside Spain.
Do I need to have finished my course?
You need the qualification or certificate for the studies completed, so finishing and being awarded it is the test.
Why does a scholarship matter?
The regulation excludes people funded under sustainable-development cooperation or humanitarian-action programmes, Spanish or from the country of origin. It is a condition of the route, not a formality.
Who pays and who applies for the employed route?
The application can be made by the employer or by you, and the regulation puts the fee on the employer.
Can my spouse come with me into the new status?
If they are in Spain on a stay as your family member and living with you when you apply, the regulation lets you apply for residence for them too.
