Health Insurance When You Renew a Spanish Student Stay

The insurance condition is not a one-off hurdle at the visa stage. When a study stay is renewed, the regulation requires that the original conditions continue to be met — and the insurance condition is one of them. So it is assessed again, against the new period.

That is where most problems come from, and they are avoidable. A policy bought to satisfy the first application is often written for twelve months. A renewal often covers longer than that. The requirement asks for cover valid for the intended duration of the stay, so a policy that stops partway through the period you are applying for is a problem even though it is perfectly valid on the day you file.

What the regulation asks at renewal

The renewal provision does not restate the insurance requirement in new words. It does something more demanding: it requires that the conditions for the original authorisation continue to be met. The insurance condition is among them, so the same three tests apply — authorised insurer, SNS-comparable benefits, validity for the intended stay — and they apply to the stay you are now asking for.

And it works the same way for applications filed inside Spain, which is how nearly all renewals are made. The regulation routes in-Spain applications through the same article-35 requirements, excluding only two lettered items that do not include insurance.

The three things that actually go wrong

The policy expires inside the renewal period. This is the big one. Twelve months of cover does not evidence a requirement framed around the duration of the stay being applied for. Check the policy's end date against the period on your application, not against today's date.

A new policy reintroduces a waiting period. Switching insurer at renewal is allowed, but a fresh policy may apply waiting periods on some benefits — and the Ministry's criteria for study stays require cover without them. A cheaper policy that reintroduces waiting periods can fail a condition the previous one met. A policy quietly converts to a different product. A policy sold against the visa requirement is not necessarily the same policy after renewal at a new premium or on new terms. The three conditions are tested against the policy you actually hold at renewal.

If your circumstances have changed

Students move between situations, and the insurance question changes with them rather than staying still.

If you have started working under the conditions attaching to a study stay, the regulation answers this directly, and in your favour: where the holder of the authorisation carries out work in the terms set out in that article, the article-35 health-insurance requirement is deemed satisfied by registration in the corresponding Social Security regime. So if you are working and registered, the insurance condition is met by that registration — you are not additionally required to hold a private policy to satisfy it. If you are not working, or your work falls outside those terms, the ordinary insurance condition applies in full.

Then the period you are applying for is longer, and the policy has to be valid across it. An extension is exactly the case where a twelve-month policy falls short.
